Basic Program for Banking Professionals Module 2: Legal Framework of Banking

Description

Objective

To educate bankers on the fundamental legal framework affecting the performance of their functions as such. The program focuses on strengthening the financial system through the capacity building of people behind it who provide important financial services to the general public. Through this capacity-building initiative, banks are expected to adhere to and comply with this legal framework.

 

Outline

1.
Supervisory and Regulatory Powers of BSP


This topic will delve into the fundamental powers of BSP granted under its revised charter (i.e., Rep. Act No. 7653, as amended) and other related laws. The participants will know the legal bases for each of the important supervisory and regulatory actions being undertaken by BSP, as well as the vital processes in coming up with certain supervisory actions.

2. Fundamental Laws Governing Bank Operations

This topic will essentially deal with a brief discussion of salient features of different relevant laws which are sources of duties and responsibilities of banks, such as the General Banking Law; Rural Bank Act, as amended; Foreign Bank Entry Liberalization Act, as amended; Islamic Banking and Finance Act; the latest amendments to the Agri-Agra Law; and the National Payments Systems Act.

3. Legal Framework of Corporate Governance System of Banks

This topic endeavors to teach the participants about legal aspect of corporate governance – the legal bases, relevant rules and regulations, and other matters related thereto. The participants will likewise learn about the legal consequences of holding the position of director, officer and employee of a bank.

4. Overview of Laws Protecting Financial Consumers

In view of the prevalent economic and social issues related to financial crimes affecting the general public, either as depositors, investors, or users of digital payment platforms, a number of legal requirements are now being imposed upon banks and other financial institutions to amply protect the integrity of the financial system and the public, in general. Compliance with the legal requirements is made mandatory under the relevant laws. In this discussion, the participants will be able to have an overview of the financial consumer protection laws, such as the Financial Consumer Protection Act (FCPA) and the Anti-Financial Account Scamming Act (AFASA). These topics only offer a brief discussion of the these laws, but to supplement their knowledge of these laws, participants are encourage to attend the more comprehensive BAIPHIL trainings on AFASA and FCPA which are being offered on a regular basis.
